License for IndxSearchLib

IndxSearchLib is free for production use. This software is provided under a proprietary license with optional paid support packages available for professional and enterprise users.

Terms of Use

1. License Grant

IndxSearchLib (the "Software") is licensed, not sold. Indx / Bionic AS ("Licensor") grants you, the licensee, a non-exclusive, non-transferable, revocable license to use the Software for any purpose, including commercial production use, subject to the terms and conditions of this License Agreement.

2. Free Tier

The Software is provided free of charge with the following conditions:

• Document Limit: Free for unlimited documents with registration. Without a registered license file, usage is limited to 100,000 documents. Register for free at https://lfut1rkw3es.typeform.com/to/jiN4Z82I to unlock this limitation.
• No Warranty: The Software is provided "AS IS" without any warranties, guarantees, or commitments of any kind.
• No Support Guarantee: Free tier users have access to community resources and documentation only. No technical support, bug fixes, or maintenance is guaranteed.
• No Service Level Agreement: There is no SLA or commitment to uptime, performance, or reliability.

3. Paid Support Packages

For users requiring guaranteed support, SLA commitments, and dedicated assistance, Indx offers the following paid support packages:

• Professional Support: Email-based technical support with priority response times
• Enterprise Support: Includes Service Level Agreement (SLA), direct engineering access, rapid response support, and a dedicated contact for your organization

4. Restrictions

Regardless of whether you use the free tier or a paid support package, the following restrictions apply:

• No Redistribution: You may not distribute, sublicense, lease, rent, lend, or resell the Software or any copies thereof.
• No Modification or Reverse Engineering: You may not modify, decompile, disassemble, reverse engineer, or attempt to derive the source code of the Software. The Software is provided in an obfuscated format to protect its intellectual property.
• Proprietary Notices: You may not remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on any copies of the Software.

5. Ownership

All rights, title, and interest in and to the Software, including all intellectual property rights, are and will remain the exclusive property of Indx. This License Agreement does not convey to you any rights of ownership in or related to the Software.

6. Termination

This License Agreement is effective until terminated. Your rights under this License Agreement will terminate automatically without notice from Indx if you fail to comply with any term(s) of this License Agreement. Upon termination, you must cease all use of the Software and destroy all copies, full or partial, of the Software.

7. Disclaimer of Warranties

FOR FREE TIER USERS: The Software is provided "AS IS" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Indx does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or error-free. You use the Software entirely at your own risk.

FOR PAID SUPPORT PACKAGE USERS: Warranties and service commitments are defined in your separate support agreement.

8. Limitation of Liability

In no event shall Indx be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the Software, even if Indx has been advised of the possibility of such damages.

9. Governing Law

This License Agreement shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of laws principles.
