FalkForge License

FalkForge is licensed under the Functional Source License, Version 1.1, ALv2 Future License (SPDX identifier FSL-1.1-ALv2). The licence text is reproduced verbatim below, followed by an Additional Grant from the licensor.

What this means in practice

The Software is FalkForge: the fluent C# API, the MSI, MSIX, MSM, MSP, MST and bundle compilers, the runtime engine, the UI framework, the extensions, the SDK, and the forge command-line tool.

You may use FalkForge to build and ship installers for your own or your customers' software, commercially or not. The Additional Grant at the end of this file permits that explicitly, as a term of the licence rather than as a summary.

You may not offer FalkForge, or a product with substantially similar functionality, as a commercial installer, packaging, or setup-authoring product. The Competing Use definition below sets the exact test, and that test turns on functionality, not on how a product is marketed.

An EXE bundle produced by FalkForge embeds the compiled FalkForge bundle engine, and by default the elevation companion as well. Shipping such a bundle redistributes part of the Software, so the Redistribution clause below applies: include a copy of these terms or a link to them, and leave the copyright notices in place. The Additional Grant permits the distribution itself.

Each version released under this licence converts to the Apache License, Version 2.0 on the second anniversary of its release. Packages published before the relicense carry the previous terms and do not convert.

This summary is not part of the licence, and where it and the terms below differ, the terms below govern. The Additional Grant at the end of this file is part of the licence.

Licensor ("We")

The party offering the Software under these Terms and Conditions.

The Software

The "Software" is each version of the software that we make available under these Terms and Conditions, as indicated by our inclusion of these Terms and Conditions with the Software.

License Grant

Subject to your compliance with this License Grant and the Patents, Redistribution and Trademark clauses below, we hereby grant you the right to use, copy, modify, create derivative works, publicly perform, publicly display and redistribute the Software for any Permitted Purpose identified below.

Permitted Purpose

A Permitted Purpose is any purpose other than a Competing Use. A Competing Use means making the Software available to others in a commercial product or service that:

substitutes for the Software;
substitutes for any other product or service we offer using the Software that exists as of the date we make the Software available; or
offers the same or substantially similar functionality as the Software.

Permitted Purposes specifically include using the Software:

for your internal use and access;
for non-commercial education;
for non-commercial research; and
in connection with professional services that you provide to a licensee using the Software in accordance with these Terms and Conditions.

Patents

To the extent your use for a Permitted Purpose would necessarily infringe our patents, the license grant above includes a license under our patents. If you make a claim against any party that the Software infringes or contributes to the infringement of any patent, then your patent license to the Software ends immediately.

Redistribution

The Terms and Conditions apply to all copies, modifications and derivatives of the Software.

If you redistribute any copies, modifications or derivatives of the Software, you must include a copy of or a link to these Terms and Conditions and not remove any copyright notices provided in or with the Software.

We hereby irrevocably grant you an additional license to use the Software under the Apache License, Version 2.0 that is effective on the second anniversary of the date we make the Software available. On or after that date, you may use the Software under the Apache License, Version 2.0, in which case the following will apply:

Additional Grant from the Licensor

This section is part of the licence. It grants permission in addition to the Functional Source License terms above. Where this Additional Grant and the Permitted Purpose or Competing Use definitions above differ, this Additional Grant governs.

Distributing an installer produced by the Software is a Permitted Purpose. This includes the FalkForge bundle engine, the elevation companion, and any other part of the Software that the compilers embed in their output. This permission applies whether or not the installer is distributed commercially, whether or not the software that the installer installs is commercial, and whether or not the recipient is a licensee of the Software.

The copy of these terms, or the link to them, that the Redistribution clause above requires means this file in full, including this Additional Grant.

This permission does not allow offering the Software, or a product with the same or substantially similar functionality, to others as an installer, packaging, or setup-authoring product. This Additional Grant does not permit it.
